These Terms of Service ("Terms") govern your (the “User”) access to and use of the website at www.myfinest.app and any related mobile applications (collectively referred to as the "Platform"), operated by Glitchverse Technologies Pvt Ltd ("Finest" or the "Company") a private limited company incorporated under the Indian law and registered under the Companies Act, 2013. By accessing the Platform or using the services provided therein (the "Services"), you acknowledge and agree to be bound by these Terms and all applicable laws and regulations. You further agree to assume full responsibility for compliance with any local laws that may apply to your use of the Platform. If you do not agree with any provision of these Terms, you must refrain from using the Platform.

The Services, all content of the Platform and all materials contained therein, including, without limitation, the Finest logo, designs, text, graphics, pictures, information, data, software, sound files, other files, as well as the selection and arrangement of such materials (collectively, referred to as the "Materials") are the exclusive property of Finest or its licensors or the Users. These Materials are protected by the applicable Indian law and international intellectual property laws.

9. Disclaimers and Limitations of Liability

The Platform, Services, and all Materials provided therein are subject to change and are offered by Finest on an "AS IS" and "AS AVAILABLE" basis. Your use of the Platform and Services is at your own risk. Finest expressly disclaims all warranties, whether express or implied, including but not limited to any warranties of accuracy, non-infringement, merchantability, and fitness for a particular purpose. Finest does not warrant that the Platform or any of its Services will operate without an error nor does it guarantee that the Platform and its servers are free from computer viruses or other harmful mechanisms. To the fullest extent allowed by law, Finest, shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use or inability to use the Platform or Services.

You agree to indemnify and hold harmless Finest, its officers, directors, employees, and agents, from and against any claims, actions, demands, liabilities, and settlements, including without limitation, reasonable legal and accounting fees resulting from, or alleged to result from, your violation of these Terms of Service.

11. Termination of Account

Finest reserves the right, in its sole discretion, to suspend or terminate your access to the Platform and Services at any time and for any reason, including but not limited to: (a) a breach of these Terms; (b) failure to comply with any applicable laws or regulations; or (c) any conduct that Finest deems inappropriate or harmful. Upon termination, your right to use the Platform and Services will immediately cease, and you agree to discontinue all use of the Platform and Services.

12. Governing Law and Jurisdiction

The Terms shall be governed by and construed in accordance with the applicable laws of India, without regard to its conflict of laws principles. Any claim or dispute arising, in whole or in part from the Services shall be settled in good faith and amicably. In the event, the dispute persists, it shall be adjudicated exclusively by a court of competent jurisdiction in the state of New Delhi

13. General Terms

If any part of these Terms is found to be invalid or unenforceable, that part will be modified to reflect the parties' intention or eliminated to the minimum extent necessary so that the remainder of these Terms will remain in full force and effect. The Company’s failure to enforce any part of these Terms shall not constitute a waiver of our right to later enforce that or any other part of these Terms.
